Terms of Use

The jobs-during-covid.workandincome.govt.nz website (the Website) is owned by the Ministry of Social Development (we, us, our). When we use the terms you and your, we are referring to any organisation or person who accesses the Website.

We have contracted Joy Business Academy to build and run the Website on our behalf.

Agreement to terms

By accessing and using the Website, you are agreeing to be bound by these terms of use and our privacy policy. We may change these terms and our privacy policy at any time. Your continued use of the Website after such changes means you consent to those changes.

About you

The services we offer through the Website (the Services) are only available to people 16 years and older.  You are only allowed to have one account that is active with us at any one time.

Accuracy of registration information

When you sign up for the Website, you must make sure that all information you provide about yourself is accurate, true and complete. If you do provide us with information that is or becomes untrue, inaccurate or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate or incomplete, we might (but won't necessarily) suspend or terminate your account and stop you from using the Website in the future.

Confidentiality

It's up to you to keep your login details and information about your account confidential. You accept responsibility for all activities that occur under your account and you must notify us immediately if someone else uses your account without permission, or if there is any other breach of security. If you tell us about any unauthorised use of your account or a breach of security, we'll take whatever action we deem necessary in response.  We might need to terminate your account with us.

Deleting your account

You can delete your account with us at any time. If you wish to delete your account please contact us to action this for you at jobs_during_covid@msd.govt.nz.

Copyright

The Website is comprised of underlying code and software and may include at any given time video clips, sound clips, text, graphics, logos, images, icons and data (together, the Website Content). The Website Content is the property of either the Ministry of Social Development, Joy Business Academy, our affiliates or third parties with whom we do business.

You cannot modify, copy, distribute, transmit, display, publish, sell, license, create derivative works or use any of the Website Content available on or through the Website for commercial or public purposes, unless otherwise indicated on the Website or unless we have given you express written permission to do so.

Content you add to the Website

If you add content to the Website, you must have all the rights you need to add that content and to ensure that our use of that content in accordance with these terms will not:

  • breach any laws, or
  • infringe any person's intellectual property rights or other legal rights or protected interests.

If we suspect that you have breached these requirements, or if we consider that a job listing is inappropriate, we may remove, suspend, amend or delete the relevant content.

We do not claim ownership of your content and we will treat it in-line with the privacy policy on the Website.

Our liability is limited

We endeavour to take care in our maintenance of this Website. You agree, however, that neither we nor Joy Business Academy Limited will be liable to you, on any legal basis (including negligence), for any loss or damage you suffer through your use of the Website, its content or any website to which it is linked, except in those cases where the law does not allow us to exclude or limit our liability to you.

Electronic communications

You consent to receive communications from us electronically and you agree that all agreements, notices and disclosures satisfy any legal requirement that such communication be in writing. You agree to be bound by any agreement reached through electronic means.

No waiver

If we do not exercise or enforce any right available to us under these Terms of Use, it does not in any way constitute a waiver of those rights.

Severability

If any provision of this Terms of Use becomes or is held to be invalid, unenforceable or illegal for any reason, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect.

Governing law

These Terms of Use shall be governed by New Zealand law, and you submit to the exclusive jurisdiction of the New Zealand courts for any matter or dispute arising in relation to these Terms of Use.
